Am I eligible to appeal my asylum application refusal?

As it currently stands, an asylum refusal can be appealed if the application was refused on the grounds of:

  • a human rights claim;
  • a decision to remove or revoke humanitarian protection or refugee status; or
  • an “international protection” issue or a decision that the application has no right to remain under EU regulations and laws.

What if I am not eligible for refugee status?

If you do not qualify for refugee status you may still be permitted to stay temporarily in the UK for humanitarian reasons under a human rights application.

Under the European Convention on Human Rights, a person should not be returned to a country where there is a real risk that they will be exposed to torture, inhumane/degrading treatment or punishment.
