How Does Coronavirus Affect my Entrepreneur Visa?

The coronavirus pandemic has led to a lot of worry and confusion about the immigration status of foreign nationals in the United Kingdom.

Covid-19 has led to widespread border closures and travel restrictions which has left many foreign nationals unable to leave the United Kingdom, including those whose visas have, or are due to, expire.

At the time of writing, Covid-19 will not lead to any changes with the operation of the Tier 1 Entrepreneur Visa itself, and all the conditions of the visa still apply.

Last week the government announced that individuals whose visas expired after 23rd January 2020 and are unable to return home due to travel restrictions or self-isolation will be able to extend their visas until 31st May.

This temporary measure for visa extensions will apply to anyone who holds a Tier 1 Entrepreneur Visa which is due to expire/has expired in this timeframe.

At the time of writing, Covid-19 will not lead to any changes with the operation of the Tier 1 Entrepreneur Visa itself, and all the conditions of the visa still apply.

Can I Apply for a Further Tier 1 Entrepreneur Visa Extension?

The Entrepreneur Visa went out of operation in April of 2019, but holders of this visa can still apply for a full Tier 1 Entrepreneur Visa extension, provided their original visa did not expire before the 24th January 2020.

Obtaining an extension to your visa will mean you are not reliant on government decisions around your immigration status. In these times of wide uncertainty, securing your immigration status is the one thing you can control.

To be eligible for an Entrepreneur Visa extension, you must meet the following requirements:

  • Invested at least £50,000 into at least one UK business (or £200,000 in cash)
  • Created at least two full-time positions which have existed for at least 12 months
  • In a position to continue to support yourself and your firm
  • Registered as a director of your company, a member of a partnership or as self-employed no more than six months after you received your Tier 1 Entrepreneur Visa
  • Have been working in your position for three months before your application for an extension

You can also apply for Indefinite Leave to Remain (ILR) status if you have lived in the UK under a Tier 1 Entrepreneur Visa for five years.

If you have created at least 10 new full-time jobs and generated £5 million, you could be eligible for ILR after just three years of lawful residence in the UK.

It is also still possible for an individual to switch to the Tier 1 Entrepreneur Visa from a Tier 1 (Graduate Entrepreneur) Visa and, in certain circumstances, from a Start-up Visa.
