According to the Home Office, any UK employers who hire non-EEA talent must complete several compulsory duties. If the employer does not comply with these duties, the Home Office will not hesitate to discipline them. These disciplines include large fines, suspension/revocation of Sponsor Licences and criminal sanctions.

An Immigration Audit is highly useful as it can help identify any areas in which a UK employer is not compliant with their immigration duties. It can then be used to help resolve these issues and ensure that the employer and organisation avoid incurring any penalties. Contact us on 0333 363 8577 or using our online enquiry form to find out if your company needs an immigration audit.

FAQs

What are my duties as a UK employer?

As a UK employer, it is your responsibility to ensure that any migrant workers you hire from outside the EEA or Switzerland are operating with a valid UK visa. You must also hold a valid Sponsor Licence in order to employ any foreign nationals who are subject to immigration control in the UK.

As a Sponsor Licence holder, you are required to keep personal details on all of your migrant employees which must be updated on a regular basis.

It is vital that UK employers and businesses keep an up-to-date record of all their migrant employees, which includes evidence and details of their right to work.

What can happen if I don’t comply to the immigration responsibilities as a UK employer?

If you do not comply with the responsibilities required of you by the Home Office, there are a number of penalties which you or your business could incur.

These include:

  • having your UK Sponsorship Licence revoked and being unable to hire migrant employees;
  • being given a Civil Penalty from the Home Office: this is a large fine and written letter of warning;
  • losing your reputation and credibility as a business or company; and
  • imprisonment
