What are the Spouse Visa eligibility requirements?

A Spouse Visa enables a non-EEA married/civil partner of a British citizen or settled person to join their partner in the UK. In order for the application to be a success, the following eligibility requirements must first be satisfied:

  • The applicant must be at least 18 years of age;
  • The applicant must have met their spouse at least once;
  • The applicant must be in a ‘genuine and subsisting’ relationship with a British citizen or settled person in the UK;
  • The applicant must hold a valid marriage or civil partnership certificate that is recognised in UK law’;
  • The applicant must meet the financial requirements;
  • The applicant must meet the accommodation requirements;
  • The applicant must meet the English language requirements.

Failing to fulfil the above criteria may lead to a Spouse Visa application being rejected by the Home Office. With this in mind, it is strongly advised that you seek the help of one of our OISC-accredited lawyers if you are considering applying.
