  1. Before the session, one of our lawyers will examine your enquiry. This means they will be prepared for your session and will know what to expect when you visit one of our offices.
  2. You will attend the session with your lawyer, either in person, over the phone or via Skype. You can choose which you prefer — your visa immigration specialist will work around your schedule.
  3. During the session, the lawyer will discuss your options with you. They will assess your eligibility: if you are eligible, they will move on to discuss what you need to apply. If you are not eligible, they will tell you what you need to do to become eligible in the future.
  4. If you meet the requirements for a particular immigration route, they will tell you what documents you need for an application. They will also tell you which form you need to fill out a correct application.
  5. This session is untimed. This means that your lawyer will spend as much time with you as is needed.

Do IAS' have fixed fees?

Yes — our advice, application and appeal packages have fixed fees which are calculated based on your type of enquiry. They are not subject to change once they have been quoted to you; there are no hidden costs or fees with IAS. When you make an enquiry with us, either by calling our office or filling out our contact form, your dedicated adviser will review your case and quote you accordingly. Your fee will be based on several different factors and will take into account the complexity of your case and the resources it is likely to take up.

Based on your enquiry, you will either receive a quote for an advice package — this is an untimed one-off session with one of our lawyers. You may also receive a fixed-fee quote for our tailored application service. However, in most cases, this will be assessed by your personal solicitor after your advice session. In this scenario, once the lawyer has assessed your case after speaking with you, they will send you a quote for an application service.

If you choose to proceed with the service, this quote will not change.

Does IAS offer legal aid?

Our legal aid services cover a variety of clients, including those claiming asylum or applying for leave to remain in the UK. Our team also provide free advice and application support for victims of domestic abuse and human trafficking. This is funded by legal aid.

These services use the same structure as our advice and application packages, so you will receive full and free legal support from one of our immigration specialists if you qualify for legal support.

My visa has been refused. Can IAS’ help me submit an appeal?

Unfortunately, no one can guarantee that your visa application is going to be successful. Nevertheless, you may be entitled to ask the Home Office to amend its decision on your case.

If you have received a visa refusal letter, you can discuss your situation with us. We will review your case and investigate the reasons for the Home Office’s rejection. To be eligible, you must prove that:

  • You are a legitimate business;
  • You need to hire a skilled workforce from outside the EEA;
  • Do not have any unspent criminal convictions nor a history of failing to carry out sponsorship duties.

When Can I Apply for Indefinite Leave to Remain in the UK?

Indefinite Leave to Remain (ILR) is a form of settled status which can be applied for after you have spent a certain period of time living in the UK. In most cases, this is five years.

As a holder of Indefinite Leave to Remain status, you can live in the UK without any immigration restrictions. You can also apply for British citizenship after you have spent one year living in the UK under ILR.

The main requirements for ILR are as follows:

  • Must have spent a certain period of time living in the UK
  • Must not have broken any immigration conditions (or any laws) in the UK
  • Must have not spent more than 180 days outside of the UK in a 12-month period during your UK residency
  • Must achieve a pass in the Life in the UK test. This is a series of questions about the history, traditions and culture of the UK
  • Must be able to demonstrate that your English language ability is to at least the level of B1 as set by the Common European Framework of Reference for Languages

If you have been living in the UK as an entrepreneur under the Innovator Visa, or under the Investor Visa, you could be eligible for ILR after three years, or even two, depending on business activities.

If you and your partner are living together in the UK on a Spouse Visa, your leave to remain is set to expire after up to 33 months. At the end of this period, you can apply for a Partner Visa extension for a further 30 months. When the extension expires, you may finally be eligible to apply for Indefinite Leave to Remain in the UK and, eventually, for British Citizenship.

The requirements for the Spouse visa renewal are similar to the original Spouse Visa.
