Risk to benefits for some EU citizens

The Guardian has reported that some EU citizens resident in the UK are at risk of losing their benefits if they fail to update their online Department of Work and Pensions (DWP) profile.

EU citizens warned to check their DWP profile

Some EU citizens may be at risk of having their benefits or welfare payments withdrawn unless they update their Department for Work and Pensions (DWP) online profile.

According to the charity the Work Rights Centre, EU and EEA nationals must upload a code from the Home Office which proves they have the right to live in the UK.

Failing to update the DWP profile with this code could result in pensions, children’s allowance payments or other benefits being stopped.

The director of the Work Rights Centre, Olivia Vicol, said that:

“Frankly, this is mass disentitlement waiting to happen. Many charities, including ours, warned that a digital-only immigration status wouldn’t remove the pressure of having to prove your rights.”

EU Settlement Scheme backlog continues

The latest figures show that the backlogged EUSS applications may be cleared by Christmas 2021.

In September, official Home Office figures showed that almost 5.5 million settlement applications were submitted to the scheme by 30th June 2021 (the closing date).

By the same date, over 4.9 million applicants had received their status, leaving approximately 660,000 applications to be processed. It is understood that the figure is now closer to 400,000.

Vicol further stated that this communication from the Home Office would add to the existing worries of those whose applicants are still pending. She noted:

“I can’t even begin to explain how anxious this will make those in the Home Office backlog, who – through no fault of their own – cannot generate the proof the DWP is demanding.”

Is it too late to apply to the EU Settlement Scheme?

The deadline to apply for the scheme was the 30th June 2021, but it is still possible to apply if an applicant has compelling or reasonable grounds for not meeting the deadline.

Some of these reasons may include illness, vulnerability, a history of abuse, or digital illiteracy.

Following the deadline, the Home Office issued a notice saying that they:

“will take a flexible and pragmatic approach to accepting late applications and will look for reasons to grant applications, not to refuse them.”

This approach may change in the future, so it is strongly advised to apply as soon as possible.
