Martin is a UK National who met Linda whilst on holiday in Nigeria.
The two kept in touch constantly over the internet and on the telephone and, after a few months, they became engaged.
Linda had made an application but it was refused, as the Entry Clearance Officer did not believe that she had only intended to visit the UK. They were worried that their intention was to marry in the UK where she would remain.
This was not the case – Linda had a good job in Nigeria and was going to stay there until both she and Michael could afford to bring her to the UK.
Upset, Linda emailed IAS to arrange an Advice Session with her attending via Skype.
Our lawyer spoke with Martin at our office in Brighton and Linda on Skype and requested a copy of her previous Application and Notice of Refusal.
Whilst she had provided the correct documents, she did not make it clear that she was on contract work and could not possibly leave her job, even if she wanted to, without negative consequences.
As such, we drew a plan of action and a list of suggested documents – this time including her employment contract with the relevant sections highlighted.
We wrote a Letter of Representation citing the law and rules and ensuring the Home Office that her intentions to visit her Fiancé were unquestionable.
Linda submitted the new application and within a few weeks, her Visitor Visa was granted.
She and Martin spent quality time together, travelled the UK and she met her future in-laws.
Before she returned to Nigeria, the couple contacted IAS to thank us and instruct our services to make their Fiancée Visa application once they were ready.
