1: The situation

Marta is a Polish national who arrived in the UK to study four years ago.

She knew that she would soon be in a position to apply for EEA Permanent Residency, but wasn’t sure what she had to do to obtain it.

Marta came to our office in Belfast on her lunch break for a consultation with one of our immigration lawyers.

2: How IAS helped

Marta was shown to one of our available immigration lawyers once she arrived.

Our lawyer went through the UK immigration requirements as well as providing Marta with a comprehensive list of the documents she would need to make an application.

One of the requirements Marta needed was to show that she had comprehensive health insurance whilst she was a student – she did not have this.

Marta was upset as she was planning on becoming a Permanent Resident the following year.

Our lawyer began to examine Marta’s time in the UK in more detail and noticed that, throughout her time studying, Marta worked as a waitress part-time.

Our lawyer drafted a list of required documents and advised Marta to produce them at a follow-up session the next week.

3: The outcome

After we met up again with Marta, we examined her documents and confirmed that she had worked enough hours to be considered a worker, instead of a student.

Our expertise and the creative solution we found for her ensured that Marta would be able to apply for Permanent Residency without any issues and gain her settlement documents in her expected time frame.
