Matthew: Working on a Student Visa

Matthew, a US national, had been studying in the UK for three years with a Tier 4 General Student Visa.

He found a potential employer in the UK but both Matthew and the employer were unclear about the correct process of hiring an international student.

Matthew contacted IAS and a lawyer informed Matthew and the employer about how Matthew could be employed legally.

1: The situation

Matthew is a US National – he had been studying in the UK for three years under a Tier 4 General Student Visa.

At a recruitment fair, he found a potential employer and needed advice with regards to his visa requirements and next steps.

Matthew found our Work Permit Clinic at the same recruitment fair and dropped in to speak to one of our lawyers about his situation.

2: How IAS helped

Our lawyer sat down with Matthew and explained how the process worked. We described the steps he would have to take to make his application before his current visa expired.

He was concerned about time as he had heard that his potential employer would have to advertise the job he was offered nationwide before offering it to him.

After providing Matthew initial advice at the clinic, his lawyer advised him to come to our office in Southampton for a full advice session.

It was then that our lawyer invited the potential employer to speak with us along with Matthew and explained that, as he was a Tier 4 Student, this rule did not apply.

3: The outcome

Matthew and his employer were satisfied with the information given and assured that Matthew’s transition from Student to Employee would be a smooth one.

IAS gave them both full written instructions for the process, detailing the timescales, requirements and documents they would both need. We also made ourselves available for any future queries or applications.
