Tier 2 Work Visa with Dependant

Hector, a Mexican National, was offered employment in the UK. He contacted IAS and spoke with one of our lawyers via Skype. Hector was told that he could not stay and work for over six months, so our lawyer suggested having another Skype consultation with Hector’s proposed employer present.

Through discussion and formulation of a plan, Hector was able to secure a Tier 2 Visa and bring his wife over as a dependent. They are now happily living in the UK.

1: The situation

Hector is a Mexican National who had been travelling to and from the UK for over 10 years, conducting short-term business meetings without the need for a Work Permit or Work Visa.

He decided to apply for a permanent position in London and was offered employment in the UK as a path towards Permanent Residency.

He requested a Skype appointment with one of our lawyers so that he could discuss his options with a legal professional.

2: How IAS helped

Our lawyer called Hector and confirmed that, as per the Immigration Rules, he could only ever stay for less than six months without a Work Visa, and that he would only be able to conduct simple business meetings without residing here.

For his long-term plans, he would need a Tier 2 Visa.

IAS suggested that we conference another call with Hector and his employer to fully outline an appropriate plan of action.

During this call, it became clear that Hector would be eligible for a Tier 2 Skilled Work Visa. This would allow him to work and reside in the UK, as well as bring his wife over as a dependant.

There was a slight issue in that Hector’s company did not yet have the status to offer him a Certificate of Sponsorship.

As part of the application assistance, IAS secured sponsorship status for the company within a week so that they could secure his CoS. After this, we immediately began Hector’s application for a Tier 2 Visa.

3: The outcome

Hectors Tier 2 Visa was successful and he was able to work in the UK in a permanent position as well as bring his wife over as a dependent.

He, his wife and his company are assured that Hector will be able to settle in the UK after a few years of residency, staying loyal to the company.
