Ajay: Family Visit Visa Appeal

Ajay’s Mother, a national of the United Arab Emirates, wanted to visit her son who lived in the UK and applied for a Family Visitor Visa but was refused.

They contacted IAS and emailed the refusal letter to the lawyer.

The lawyer examined the refusal letter and determined the reason why she was refused and instructed Ajay on her next steps. A few weeks later, Ajay’s mother was spending a quiet afternoon in the UK with her son and grandchildren.

1: The situation

Ajay was a Dual Citizen of Dubai and the UK. He wanted to bring his mother to the UK to visit him and his family.

The Entry Clearance Officer refused her visa as they were not convinced that, if she had entered the UK, she would return home.

Ajay was upset as his mother was elderly and he wanted his children to spend more time with her.

After reading our reviews online, Ajay emailed IAS and scheduled an appointment the same day to speak with one of our immigration lawyers in Liverpool.

2: How IAS helped

Before Ajay’s advice session, our lawyer requested a copy of his mother’s Refusal Notice.

Once we had received this and our lawyer was speaking with him, we determined that his mother did not have anything in her name back in Dubai that would be considered a reason to return there.

Ajay told us that he owned his mother’s house and that they had tenants.

With this in mind our lawyer suggested that, if he could arrange for the deeds of the house to be transferred to his mother, she would have a much more compelling reason to return.

Ajay agreed and made the change – we highlighted the importance of this in his Letter of Representation along with the importance of letting his mother spend time with her grandchildren.

3: The outcome

Ajay was anxious as he waited for the decision – changing the deeds had not been an easy process.

However, after a few weeks’ wait, her application was accepted and she was granted a Visitor Visa.

With our help and creative solutions, Ajay’s family were able to spend quality time together in the UK.
