Overview of US Visa Renewal in Nigeria

If you have a US visa and it has already expired or is expiring soon, you need to consider renewing the same to legally enter and stay in the US for your authorised period of stay.

Nonimmigrant US visa renewals will need to be filed and processed in the US embassy or consulate in your home country i.e. Nigeria in this case.

Your nonimmigrant visa may expire while in the US. A visa is basically an entry document to the US. As a nonimmigrant, you can stay in the US even if your visa has expired as long as your Form I-94, the Arrival-Departure Record Card, allows you to stay, and unless you are deported from the US for any criminal or illegal activities.

However, if you are travelling outside the US and your visa expires, you will need to renew it before you seek entry to the US again. It is always advisable to apply for a visa renewal in a US consulate or embassy in your home country.

You cannot apply for a nonimmigrant visa renewal in the US. Visa renewal application from ‘third’ countries, even when technically permitted, see a higher rejection rate.

US Green Card holders can renew their lawful permanent residency status in the US or outside the US. In this article, we’ll be discussing the renewal process of US nonimmigrant visas in Nigeria. However, we will also briefly touch upon the Green Card renewal process towards the end of this article.

Am I Eligible to Renew My US Visa in Nigeria?

To be eligible for renewing your US visa in Nigeria, you need to meet the following criteria:

You are renewing the same visa
You still fulfil the eligibility requirements for that visa category
US visa authorities have not denied any other visa application made by you since the issuance of your previous visa
You never have had a US visa revoked or required a waiver
You seek to renew a US visa with multiple entries, and with more than one-year validity
Your previous US visa expired within the past 48 months or will expire in three months

Can I Avoid Attending an Interview for a Visa Renewal in Nigeria?

To be eligible for a visa renewal in Nigeria without appearing for a visa interview, you must meet the following requirements:

You are a citizen or resident of Nigeria
You are applying to renew a B, F, M, J (academic only), H, L or C1/D (combined only) visa
Your previous visa was issued in Nigeria
You are renewing the same visa as previously
Your previous US visa expired within the past 48 months or is set to expire in three months
You have your passport(s) covering the entire period since receiving the previous visa as well as the passport with the most recent visa
You don’t have any criminal record in the US
You have not broken any immigration rules while in the US e.g. worked without authorization or remained beyond your authorised stay as per your Form I-94 record
You are able to submit your passport for the entire length of the processing period which can be up to two months

Nigerian nationals, including minors, who seek to renew their US visa without appearing for a visa interview, will need to meet the above conditions individually.

Please note that even if you were not convicted, or if you received a waiver or pardon later, any criminal record in the US will make you ineligible for US visa renewal.

US Visa Renewal Process

Overview

The process to renew a US visa is similar to your original visa application process. You have to:

Complete Form DS-160
Schedule a visa interview appointment
Pay the non-refundable, non-transferable visa renewal fee (same as the visa application fee based on your visa category)
Submit the required documents for US visa renewal
Appear for the visa renewal interview (not required for applicants eligible for an interview waiver)

Complete Form DS-160

The US visa renewal process starts with completing Form DS-160 online. This is the same online nonimmigrant visa application form that you completed while applying for your original visa.

You may complete Form DS-160 through the Consular Electronic Application Center. Once completing the form, you will be redirected to a confirmation page. Please take a printout of the confirmation page. You will need to carry this page with you to your visa interview and/or submit as part of your required documentation.

Schedule Your Visa Interview

Please schedule your visa interview at either the US embassy at Abuja or the US consulate at Lagos, depending on your location. Visit their concerned websites for contact details as well as instructions on how to schedule an interview.

This step is not required for the applicants eligible for an interview waiver (IW).

If You Are Eligible for An Interview Waiver

If you are eligible to renew your visa without a visa interview, you will need to first complete Form DS-160.

Your eligibility, as per the afore-mentioned criteria, will be established during the application process itself. During the scheduling process, you will be asked to confirm your eligibility for interview waiver. Instructions will be provided at this stage regarding how to submit your renewal application.

You may drop off your IW applications at the DHL Surulere, Isolo, Victoria Island and Abuja locations.

US Visa Renewal Fee

Visa renewal fee is the same as the visa application fee based on your visa category.

The application fee for visitor visas for business or tourism (B), and other non-petition based nonimmigrant visas, e.g. student and exchange visitor visas, is $185.

The fee for certain petition-based nonimmigrant visas for temporary workers (H, L, O, P, Q, and R) is $205, whereas the fee for a treaty trader, treaty investor, and treaty applicant in a specialty occupation (E) is $315.

All nonimmigrant visa application fee payments are valid for 365 days from the date of the payment receipt. Please schedule your visa interview appointment or submit an IW application during this 365-day window.

US Visa Renewal Interview

If you are required to appear for a visa interview, the consular officer may ask you why you are applying to renew your visa, your planned itineraries, or any other information depending on your immigration situation.

You may be required to submit further documents based on the information you provide during the visa interview.

US Visa Renewal Timeline

Visa renewal application processing may take from a few days up to two months. The applicant’s passport will be with the concerned US embassy or consulate during that period of time.

Validity of the Renewed US Visa

Typically, the new visa comes with the same validity and conditions as that of your expired visa.

Two 2×2 photos in the prescribed format as per the US visa photo requirements

What If My US Visa Renewal Application Is Denied?

In most cases, renewal applications for US visas are rejected because of incomplete or insufficient documentation. If your renewal application is denied, you will be informed about the reason for denial.

How to Renew My Expired Green Card in Nigeria

If you are a US Lawful Permanent Resident (LPR), also known as a Green Card holder, currently in Nigeria, you can apply to renew your expired Green Card in the country.

If you have remained outside the US for less than one year, or within the validity period of a re-entry permit, but are unable to travel to the US due to an expired or lost Green Card, you will need to apply for a boarding foil to re-enter the US to resume your permanent residence.

If you have remained outside the US for more than a year, or beyond the validity period of a re-entry permit, you will require a new immigrant visa (SB-1) to request re-entry to the US to resume your permanent residence.

Please note that SB-1 visa applications may not always be successful. A consular officer will assess your individual situation during an SB-1 interview to determine if there have been circumstances beyond your control compelling you to miss your Green Card renewal deadline.
