If are a non-EEA national and you wish to study in Newcastle, you will need to apply for the Student Visa. To be eligible, you must intend to study a full-time degree in Newcastle and must have been offered an unconditional place on a course.

In your Student Visa application, you will need to demonstrate that you have enough money to support yourself and any dependents whilst you are in the UK, without the need to rely on public funds.

If your Student Visa application is accepted, you will need to provide your biometric information (photo and fingerprints) at a visa application centre. You will need to collect your Biometric Residence Permit within ten days of arriving in the UK.

You can extend your Student Visa before it is due to expire as long as your circumstances haven’t changed significantly.

You will need to apply for a visa to visit the United Kingdom if you are a non-EEA national, even if you only plan to stay in the UK for a short period of time.

Typically, you can apply for Indefinite Leave to Remain (ILR) after you have spent five years lawfully living in the UK. This includes if you have been living in the UK under a Spouse Visa, Unmarried Partner Visa, a work visa and an Ancestry Visa.

In certain circumstances, you could be eligible for ILR sooner. For instance, if you have been living in the UK under the Investor Visa or Innovator Visa, you could be eligible after just three years of UK residency, or even two, depending on your business activity.

In rare circumstances, you may need to have lived in the UK for longer than five years to be eligible for ILR.

The fundamental requirements for Indefinite Leave to Remain are as follows:

• Must have lived in the UK for the relevant period of time pertaining to your visa/individual circumstances.
• During the residency qualifying period, you must not have spent more than 90 days outside the UK in a 12-month period.
• You must not have broken any immigration law/condition or any other laws.
• You need to achieve a pass on the Life in the UK test. This test is a series of multiple-choice questions based on the history, customs and culture of the UK.
• Must be able to demonstrate that your English language ability is a level of B1 in reading, writing, speaking and listening as set by the Common European Framework of Reference for Languages.

Indefinite Leave to Remain (ILR) is a form of permanent residence, which means you can stay in the UK without any restrictions if your ILR application is successful.

After you have spent 12 months living in the UK under ILR, you will be eligible for British citizenship, provided your circumstances haven’t changed significantly in those twelve months.

The Spouse Visa is perhaps the most popular UK visa of all and is a highly sought-after immigration permission.

If you are married to/in a civil partnership with a UK citizen or person with settled status, you could be eligible for a Spouse Visa.

The Spouse Visa is valid for 30 months if applied for from inside the UK, and 33 months if applied for from outside the UK. You can also apply for a Spouse Visa extension before your original visa expires.

However, there are a number of requirements which you must fulfil, and you will need to provide substantial evidence to prove your eligibility.

The main requirements for the Spouse Visa are as follows:

• Must be at least 18-years-old
• Must be in a marriage/civil partnership which is recognised in UK law. (You will need to provide a valid certificate)
• Must have lived with your partner for at least two years
• Must meet the ‘genuine relationship’ requirement
• Must have a combined annual income of at least £18,600. If you have any dependents, the minimum income threshold increases by £3,800 and a further £2,400 per dependent for every other dependent
• You will need to prove that you have suitable accommodation to live in in the UK
• Must be able to demonstrate that you can understand and communicate in English to a certain level

We understand that receiving a visa rejection can be stressful and devastating news. The Immigration Advice Service is here to provide support.

The first step is to understand why your application was rejected. The reason for the rejection will be highlighted on the rejection letter. If there was an obvious mistake made, the best course of action is to submit a new application with the mistakes rectified.
