    Am I Eligible for the Spouse Visa?

    The Spouse Visa is designed for non-EEA nationals who wish to reunite with their spouse/unmarried partner in the UK. However, with the Spouse Visa comes notoriously strict requirements for applicants.

    The main requirements for a Spouse Visa are as follows:

    • You must be at least 18-years-old
    • Your partner must be a UK citizen or person with settled status
    • You must be married or in a civil partnership which is recognised in UK law
    • You must have lived with your partner for at least two years prior to your application
    • You must have adequate accommodation to live in in the UK
    • Must be able to demonstrate a combined annual income of at least £29,000
    • If you are from a non-English-speaking country, you will need to undertake an English language test to prove you can understand and communicate in English to a certain standard

    With a Spouse Visa you can live in the UK for up to 2 and a half years. You can work and study in the UK without any restrictions. Also, you can apply for a Spouse Visa extension when your Spouse Visa expires which grants permission to remain in the UK for a further 2 and a half years.

    Once you have lived in the UK for five years, you will be eligible for Indefinite Leave to Remain. This immigration permission permits you to remain in the UK without any restrictions. Also, after you have lived in the UK under Indefinite Leave to Remain for one year, you will be eligible for British citizenship.
