Background
IAS were approached by a Honduran woman in her late 60s who required assistance with an asylum appeal. Her initial asylum application was submitted without legal representation, which resulted in errors when presenting her case.
The client was targeted by a gang in Honduras after her grandson was murdered, having received death threats if she did not pay them money that her grandson had owed.
What Were the Challenges with the Case?
Due to the client’s trauma, it took several appointments for our lawyers to fully take her witness statement. There was also a long history of issues relating to the gang in question that had to be recorded in the witness statement.
How Did Our Lawyers Help?
As well as taking a detailed witness statement from the client, statements were also taken from other family members in order to corroborate some events.
A case and Appeal Skeleton Argument was eventually built for the client, including information relating to the social structure of families and gang members in Honduras to support the client’s refugee appeal case.
The case, along with an evidence bundle, was presented to the Home Office, along with compelling arguments that the client could not obtain necessary protection in Honduras or internally relocate due to her physical and mental health problems.
What Was the Outcome?
The negative decision was ultimately withdrawn in October 2024 and the client was granted refugee status.
