Background
Our lawyers were approached by an Iraqi national and his family to assist with a complex asylum appeal case.
The family were under threat from the client’s paternal cousin, who was married to the client’s niece and was assaulting her. The client’s niece had previously approached the client for help in August 2022 and before going to the Kurdistan Party (PKK), which led to the client’s family receiving death threats from the cousin.
What Were the Challenges with the Case?
The client’s paternal cousin was a high-ranking politician in the Kurdistan Democratic Party (PDK) affiliated with the PDK Asaesh. The client feared that if he returned to Iraq, he and his family would be killed because of the issues with his cousin, his brothers and father.
Additionally, the client’s wife was at risk of being killed by her family due to accusations of disloyalty on the basis of leaving them to join the client. Tribal rules dictated that the shame would be cleared by killing her.
The initial asylum claim made by the client was refused by the Home Office on grounds of credibility, which led to the client seeking help from IAS’ legal advisers.
How Did Our Lawyers Help?
After securing Legal Aid funding, our lawyers took detailed witness statements from the client, his wife and their eldest son to fully understand how we could best assist their appeal.
A bundle of evidence was compiled along with objective evidence and case law to help form a compelling case for the appeal.
What Was the Outcome?
The case was heard before an Immigration Judge at the Tribunal in Newport. One of our caseworkers advocated the appeal, leading to a successful overturning of the claim refusal.
The appeal was allowed on all grounds and the family have been granted refugee status.
