Some UK visa categories allow in-country switching, while others require applicants to leave the UK and apply from abroad. You must meet the criteria of the new visa, including work, financial, and sponsorship conditions, depending on the visa type.

To switch from an eligible visa to a new one in the UK, you must apply for it (before your existing permission expires), usually online. You will also need to attend a biometric appointment, unless the UKVI can reuse the biometric information you provided previously.

  • Worker on a Skilled Worker Visa gets married to a British citizen or an individual with settled status in the UK and wants to switch to a Spouse Visa.

When You Cannot Switch Visas in the UK

Not all UK visa types are eligible for switching, including:

  • Your immigration status can determine your eligibility to switch visas: Individuals on immigration bail or those permitted to remain in the UK outside the immigration rules (if granted on compassionate grounds) cannot be allowed to switch visas.
  • Your travel may be restricted when you switch visas: Once you have applied to switch your UK visa, leaving the country before getting a decision will result in the withdrawal of your application.
  • Your dependent family member(s) must apply separately, as your application cannot cover for theirs.

Examples of Visa Switching Restrictions

Some instances of visa switching restrictions include:

  • All UK visas are not eligible to be switched within the UK: If you’re on a UK Visitor Visa, you can attend job interviews and potentially secure a job offer in the UK but can’t work. You must leave the UK, return to your home country, and apply for a Work visa to work for your employer in the UK.
  • Your immigration status determines your eligibility for visa switching: If the Home Office has detained you and granted you an immigration bail under specific conditions, you cannot switch to another visa in the UK. You can only switch visas if your immigration case is resolved and they allow you to remain in the UK on an eligible and current visa.
  • Restriction of travel: If you already applied to switch your UK Graduate Visa to a Skilled Worker Visa, you shouldn’t leave the UK, Ireland, the Channel Islands and the Isle of Man (the common travel area) without getting a decision on your application, otherwise, the Home Office may withdraw your application. If your application is withdrawn, you must obtain a new visa from outside the UK to re-enter.
  • Dependent family members’ applications must be filed separately: While switching your UK visa before your current visa expires, your partner or children (dependent family members) must do so before their visas expire. They need to apply to switch their visas separately.

Which Visa Types Cannot Be Switched?

The visa types that are not eligible for switching include:

Short-term Student Visa

The Short-term Student Visa allows foreign nationals to enter the UK to study English language courses. This visa is valid from 6 to 11 months. To apply for this visa, your UK study course must last for more than 6 months but not beyond 11 months.

Visitor Visa

The Visitor Visa allows visa nationals to enter the UK for short-term reasons, including family visits, business, tourism and leisure. Before getting this visa, you must meet several requirements, including having enough finances to cover your expenses and your intention to leave the UK at the end of your stay. This visa is valid for 6 months.

Parent of a Child Student Visa

The Parents of Child Student Visa is designed for individuals whose children are aged between 4 and 11 and are attending an independent school in the United Kingdom. To apply for this visa, your child must already have or is currently applying for a Child Student Visa. This visa is valid until the child turns 12 or the Student Visa expires (whichever comes first).

Domestic Worker Visa

A Domestic Worker Visa allows foreign nationals to work in private homes of their UK employers. Each domestic worker must return to their home country once their stay finishes, as this visa cannot be switched to another one within the UK. This visa is valid for 6 months.

Seasonal Worker Visa

The Seasonal Worker Visa allows foreign nationals to enter the UK and work in specific seasonal roles, such as horticulture or poultry production. You can work in horticultural roles (picking flowers, vegetables or fruits) for up to 6 months. You can work in poultry roles from October 2 to December 31 in the same year. While you can apply for horticultural Seasonal Worker Visas at any time of the year, you should apply for poultry Seasonal Worker Visas by November 15 each year.
