Overview Of The UK Artist Visa
As mentioned above, there’s no official Artist visa. However, there are a few routes that artists can use to live and work in the UK, including:
- Global Talent Visa
- Permitted Paid Engagement visa
- Temporary Work – Creative Worker visa
- Skilled Worker visa
The most popular one (that is typically called the artist visa when referring to artists) is the Global Talent Visa. In most of this article, we will discuss the Global Talent visa and use the term “Artist visa” interchangeably with Global Talent visa. Thereafter, we will look at the other options briefly.
What is the Global Talent visa for Artists?
It is a visa aimed at those who are leaders in a chosen field within the combined arts, dance, literature, music, theatre or visual arts. This is a long-term visa that is usually issued for up to five years, after which you can apply for Indefinite Leave To Remain (ILR) and, in some cases, the qualifying time can be reduced to three years.
If you are considering applying for a Global Talent Visa, one of the most attractive benefits of the immigration route is that holders are able to sponsor their dependents to accompany them to the UK.
Applying for a visa can be overwhelming for many, and submitting an incomplete application could lead to significant delays or even possible refusal. Therefore, you may wish to seek the advice of a professional immigration lawyer who can guide and support you throughout the process, especially as application fees are, in most cases, non-refundable.
UK Artist Visa Eligibility Criteria
The UK Global Talent Visa requires that individuals meet certain requirements in order to be eligible. It is important to ensure you can fulfil the Home Office criteria before applying. You must also be able to provide paperwork to support your application.
One of the key requirements of an Artist Visa is an endorsement from an approved body. The exact endorsement process will depend on which arts field you have experience in and which is relevant to your application.
Arts and Culture Endorsement
To obtain an endorsement in the Art and Culture sector, the following must be met:
- An eligible applicant must have three letters of recommendation from a Home Office-approved organisation such as the Arts Council England.
- Must be able to demonstrate that they have been engaged professionally in producing a piece of outstanding work of art.
- Be able to demonstrate a substantial track record in more than one country.
- A clear record of regular professional work in their specific field within the last five years.
- Media recognition of performances or work in at least two countries.
- Evidence of exceptional promise from at least one country.
Film and Television Endorsement
If applying for an endorsement within the field of film and television, then you need to demonstrate the following:
- Three evidenced letters of endorsement from relevant bodies.
- An internationally recognised industry award (e.g., a BAFTA, Emmy Award or an Academy Award)
You must also be at least 18 years of age to be eligible for the Artist Talent Visa.
If you are uncertain about your eligibility status, then you may wish to seek advice from our team of professional immigration specialists. You can do this by calling +44 (0)333 305 9375 or reaching out to us online today for information on applying for a UK Artist Visa within the UK.
How to Apply For The UK Artist Visa (Global Talent Visa)
The first thing to consider when applying for a UK Artist Visa is to determine if you are eligible for a UK work visa. This means that you should be a leader or an emerging leader in your specific field and be endorsed in the UK by a Home Office-recognised endorsing body.
How to Find an Endorsing Body for Your Application
The endorsing bodies will be able to assess and approve you based on your application, including your experience, contributions and endorsement in your field of expertise. You must identify an endorsing body which is appropriate for your field of work. It is important to pay close attention to each organisation’s requirements before making an endorsement application. An example of an endorsement body which could be used in your application would be the Arts Council England which would allow you to gain evidence of endorsement, exceptional talent or exceptional promise.
Preparing Your Documentation
You should ensure that you obtain all the necessary documents to support your application. These often include:
- Proof of endorsement from an endorsing body.
- Valid travel document or passport
- Letters of recommendation from experts in your sector of work.
- If applicable, provide proof of proficiency in the English language.
- Evidence of your previous awards, work, achievements and publications.
- An-up-to-date resume
If any of your documents are not in English or Welsh, an additional fee will be required for certified translated copies to be issued.
Completing the Online Application
This can be done by visiting the UK government’s official visa application website and completing the appropriate online form.
You will also need to pay the correct visa processing fee when making the application. The total cost of applying for the Artist Visa is £716, although this will need to be paid in two parts due to the endorsing requirement.
Initially, applicants will need to pay £524 when applying for the endorsement and then a further £192 when submitting the visa application form. If you are applying based on an eligible award, you will be required to pay the full £716 when completing your visa application.
For Artist Visa applicants planning to bring dependants to the UK, a further £716 is required for each family member. This can be paid when applying for the initial visa if you plan to travel to the UK with your loved ones. Alternatively, it is possible for your dependants to join you once you have settled in the UK.
Attending a Biometric Appointment
Part of the application will require applicants to attend an appointment at their nearest Visa Application Centre to provide biometric information such as fingerprints and photographs. There is no additional charge for this, and is covered in the Global Talent Visa cost.
Attending an Endorsement Review
After an online endorsement application is made, an endorsement body will consider and review your application and make the decision to reject or approve it. If your endorsement review is granted, you will receive an endorsement letter from the body. You will need to submit this endorsement document as part of your visa application.
If the application is declined, the body will provide details of why your request was denied and give details of the grounds for refusal. You may wish to seek legal advice if you feel the decision was incorrect and want to request an endorsement review.
The review will be conducted by the endorsing body that assessed your initial application. There is no fee involved in requesting an endorsement review.
You must provide a reason why you feel the decision should be reviewed. Possible reasons may include:
- Failure of the body to correctly consider a piece of evidence
- The application was not processed correctly
It is not possible to provide extra evidence to support your endorsement as part of the review, and the panel’s decision is final. You will need to resubmit a new application with any new paperwork, and you will be required to pay the associated fees again.
You must request a review within 28 days of being notified of the original rejection, and this should be done via the official Global Talent Endorsement Review Form.
It is advisable to seek the advice of an immigration lawyer if you are considering requesting a review.
Submitting Supporting Documents
Once an endorsement organisation has accepted your application, you must submit the endorsement letter along with other supporting documents which are required for your Artist Visa UK application to the UK Visas and Immigration service.
This is a crucial part of the application and it is important that all required paperwork is submitted correctly. Here at IAS, we offer a comprehensive document-checking service to ensure that you provide the required evidence and avoid the Home Office having to request additional documentation. Get in touch today to find out more about this and other support we can offer those looking to relocate to the UK.
Paying The Immigration Health Surcharge
A fee called the Immigration Health Surcharge is required to be paid as part of your UK Artist Visa application. This fee covers access to the UK’s National Health Service (NHS) which will provide access to free healthcare once your Artist Visa UK application is successful.
If Required, Attend An Interview
You may be asked to attend an interview as part of your Global Talent Visa, this is usually located at an embassy or consulate nearest to you. It is essential that you attend the appointment and answer all questions honestly and truthfully. The interviewer may also request to see details of your endorsement and other evidence you have submitted as part of your application.
Wait For A Decision to Be Made
After your Artist Visa application has been completed and submitted, you will need to wait for a decision. This is within 3 weeks if located outside the UK or up to 8 weeks if applying inside the UK.
If you require a quicker time for the decision to be made, you may be able to pay for a shorter processing time. How this is done will depend on whether you are already within the UK or outside of the UK. Although paying this premium fee will have no effect on the outcome of the decision, just quicker processing.
Collect Your Biometric Residence Permit (BRP)
If your Artist Visa UK application is approved, a Biometric Residence Permit (BRP) will be issued to you. You must collect this within a specified time period after you arrive in the UK.
It is highly vital to note that completing your UK visa application process can be challenging for many, and it is advisable to speak to a qualified immigration expert, such as our highly qualified team at IAS to receive legal advice or guidance to ensure a smooth and successful application.
It should also be noted that requirements could change due to increased demand or many other varying factors, so it is always very important to seek out the latest guidance before completing your application.
Limitations of The Global Talent Visa
There are some limitations and prohibitions which should be considered when applying for the UK Artist visa or the Global talent visa. For example, the UK Talent Visa can allow a person to stay within the UK between one to five years, depending on the circumstances of the application. Whilst this does allow some element of flexibility, this could lead to some uncertainty when long-term planning.
However, after 5 years, permanent residence could be gained by applying for indefinite leave to remain. It should also be noted that gaining a UK Artist Visa is a complex and lengthy process which, if completed incorrectly, could lead to the refusal of entry to the United Kingdom. In order to gain the endorsement required, the applicant must be at the top of their field and be widely credited for their effort and achievements.
The various documents which are needed for the application process could also cost the applicant and along with the application fees, could provide a significant barrier to those without the financial means to apply.
Therefore it is highly advisable to contact our trained immigration specialists for advice on whether this is the best choice of visa for you. Our experts at IAS can also provide essential immigration advice when applying to live and work within the UK.
How to Extend the Global Talent Visa (for Artists)
It is possible to apply to extend an Artist Visa if it was issued based on an endorsement and the body which endorsed you has not withdrawn this endorsement. You can also apply to extend the visa if it is based on an eligible award that you have won and this award is still recognised.
When applying to extend your visa, you must be able to show that you earned income in your field of expertise during your time in the UK. You will need to submit evidence demonstrating this, such as bank statements or payslips.
If you, the applicant, have dependants with you, they will need to apply separately to get a visa extension. This could be done at the same time as you or at any time before their visa expires. All applications for extensions should be completed before the visa expires at the five-year mark otherwise, they will have to return to their home country.
What if a Global Talent Visa (Artist Route) is Refused
There are a number of reasons why the Home Office may decide not to issue a visa, and it is important to avoid potential issues by submitting a comprehensive application.
Your Artist Visa application may be refused if you fail to provide a clear or coherent account of an applicant’s achievements and experience in their respective field. The Home Office will want to see evidence that clearly displays an artist’s talent and a successful career.
Not providing letters of recommendation or endorsement could also lead to a refusal of application, barring entry to the UK and blocking the Global Talent Route.
Therefore it is highly important to realise and understand why your Artist Visa application was declined and to seek help and advice on how to receive a successful application in future and to become a creative worker within the UK.
If you are unsure about applying for a visa after a previous rejection or are concerned about your request being denied in future, the team at IAS can guide you through resubmitting an application using the Global Talent Visa route and gaining successful entry into the UK to work in the creative sector.
It is therefore recommended that you speak to an immigration professional at IAS by calling +44 (0)333 305 9375 or connecting with our team online to kick start your application for a successful Artist visa application.
