Enhanced FBI Checks and Longer Processing Times
It is reported that pending and future applications for green cards, asylum and naturalisation/citizenship are to be subject to enhanced FBI checks ahead of approval.
Reuters reports internal communications to USCIS staff stressed the need to ensure applications are vetted via the FBI.
“USCIS will begin receiving enhanced criminal history record information (CHRI) for all fingerprint-based background checks submitted to the FBI’s Next Generation Identification system,” said the internal USCIS email.
The move is likely to increase processing times for those looking to relocate to the US. Although applications for other US visa and pathways including the H1-B visa will not be impacted by the new checks.
H-1B Cap Lottery FY 2027 Completed
For those applying for a H-1B visa it was confirmed that the next round of selections has now been completed. USCIS has yet to reveal if it will run another lottery this year but only if the allocated 85,000 visas are not issued.
If your application has been selected, then your employer must file petitions before the end of June. The recent changes to the H1-B process means it is important to submit detailed information about job requirements with increased scrutiny expected.
Last year’s changes to the H1-B fees also mean that if an employer files while the potential visa holder is outside the US or travels overseas while the case is being processed, the application will be subject to the higher $100,000 fee.
