If you’re in a situation where your current visa expires while you are waiting for another one, you have the right to remain in the UK until a decision on your application is made. This is provided under Section 3c of the Immigration Act 1971.
You must remember to apply for a visa extension or another visa before your current visa expires—the specific time depends on the visa type you currently hold. Can I Work If My Visa Expired While Waiting for Another One?
Working if your visa has expired while waiting for a decision on another visa is permitted as long as you submit your application before your current visa expires. You must ensure that your work meets the same conditions indicated in your previous visa.
If you have applied to extend your visa after your current visa expires, you no longer have a valid work permit and cannot legally work in the UK. Similarly, if you are no longer sponsored to work for your employer or have worked more than the permitted hours, you may lose the right to work in the UK.
Your employer must check that you have the right to work in the UK. If you’re waiting for a decision on your visa and have applied before your previous visa expired but do not have the documents to prove your eligibility to work, your employer can use the Employer Checking Service on the government’s website to check your right to work.
Can I Continue to Study If My Visa Expired While Waiting for Another One?

- £500 if your visa does not allow you to settle permanently in the UK.
With Super Priority Service, you may receive your visa extension decision by the end of the next working day after you provide your biometric information. In addition to the application fee, you must pay £1000 for this service.
