In most cases, if you are a non-EEA national and have been resident in the UK legally for five years through any of the various immigration routes, you could be eligible to apply for Indefinite Leave to Remain status (ILR). A Spouse Visa is a type of Family Visa that means a non-EEA national can join their partner in the UK for a period of 30 months. Your partner must be a British citizen, a settled person or British refugee. There are multiple eligibility criteria, but you must prove you are in a genuine relationship, which included living together, for at least two years to make an application.
