Why You Need an Immigration Lawyer in Dartford

Navigating the UK’s immigration system can be daunting. With the periodically changing laws, strict eligibility requirements, and complex procedures, securing the right visa or immigration status is rarely straightforward. This is why it’s essential to seek expert legal guidance.

Additionally, UK immigration laws can be complex as they encompass various aspects of immigration in the UK, including family reunification, visa extensions, work visas, settlement and citizenship applications, and asylum applications.

Top Reasons to Choose an Immigration Lawyer in Dartford

Immigration lawyers offer various services that can help you avoid common errors in your visa application. The reasons to choose an immigration lawyer in Dartford include:

  • A minor error in your documentation or a missed deadline can result in the refusal of your application or a delay in your appeal. Our lawyers help to avoid common application errors
  • Legal support from an immigration lawyer provides the clarity needed to ensure compliance with the demanding UK immigration laws and regulations.
  • A common challenge UK visa applicants face is understanding which visa route best suits their circumstances. If you misinterpret the eligibility requirements or provide incomplete documentation, the Home Office may deny your application. An immigration lawyer can assess your situation and help you determine the appropriate route that suits your circumstances. An immigration lawyer can also help you gather the necessary documents required to support your application.
  • Filing an appeal requires detailed arguments and a strategic approach to overturn refusals. An immigration lawyer can help you to professionally prepare a comprehensive appeal and represent you in court proceedings.
  • Hiring a Dartford-based immigration lawyer provides you with an attorney who understands the area’s specific legal context and community dynamics.

At IAS, our Dartford-based immigration lawyers provide personalised support, prompt response times, and assistance with all your immigration needs.

Legal Regulations and Immigration Adviser Standards

It is essential to work with accredited immigration professionals when seeking immigration advice to avoid misinformation, poor representation, or immigration fraud. To offer immigration advice and services legally, immigration advisers must be licensed by the Immigration Advice Authority (IAA), formerly the Office of the Immigration Services Commissioner (OISC), or the Solicitors Regulation Authority (SRA).

Overview of GOV.UK Code of Standards for Immigration Advisers

The UK government specifies the Code of Standards for immigration advisers. These include principles such as providing accurate legal guidance, maintaining confidentiality, acting in the best interests of clients, and ensuring transparency about fees and services. Immigration advisers must comply with the Code of Standards to ensure that clients receive fair, lawful, and effective support.

IAS Compliance and Quality Assurance

IAS adheres strictly to the UK government’s Code of Standards for immigration advisers. As an immigration firm licensed by the Immigration Advice Authority (IAA), we operate in full compliance with their standards, and our immigration lawyers meet the high standards required by the Solicitors Regulation Authority (SRA). This commitment to regulation and ethical practice ensures our clients benefit from high-quality and lawful immigration advice. We also maintain an internal quality assurance program to monitor and continually improve the services that we offer our clients.

Summary of Competencies Expected at Various Advice Levels

Immigration advisers are classified across different levels of competencies, which align with the level of difficulty in the immigration advice and services an organisation or qualified person can provide. The competency levels include:

  • Level 1: Immigration advisers in this level can assist you with basic immigration advice within the immigration rules.
  • Level 2: This category of immigration advisers handles more complex casework, including applications that don’t fall under the immigration rules.
  • Level 3: Immigration advisers at this level can provide you with advice on immigration, asylum, and protection. They can also support you with Judicial Review cases and Management advice.

Frequently Asked Questions

There are many immigration solicitors operating in the Dartford area and each one offers a different range of services. Our Dartford immigration lawyers offer assistance in all areas of immigration law, including Indefinite Leave to Remain (ILR).

Indefinite Leave to Remain is a form of permanent residence. This means you can remain in the country without any restrictions as an ILR holder.

Generally, you can apply for Indefinite Leave to Remain after you have spent five years lawfully living in the UK. This includes those who have been living in the UK under a Family Visa, Tier 2 work visa and Ancestry Visa.

In certain cases, you could be eligible sooner. For instance, if you have been living in the UK under an Innovator Visa or Investor Visa, you will be eligible after just two years of UK residency, or even two.

After you have spent 12 months living in the UK under Indefinite Leave to Remain status, you will be eligible for British citizenship.

To find out more about how we can help you to secure permanent residence in the UK, please call us now on 0330 433 1213.

Yes, we offer full support to those who would like to hire overseas nationals. There are a number of conditions which you must meet in order to be eligible to hire an overseas national, and there are certain duties which you must uphold too.

The first thing you will need to do is apply for a sponsorship licence. You will need to designate certain people within your business to manage the Sponsorship Management System (SMS). The roles which you will need to fill are:

  • Authorising officer: A senior position responsible for the actions of all the members of the staff and representatives who use the SMS
  • Key contact: They will be the main point of contact with the UKVI
  • Level 1 user: They will be responsible for all daily management of your licence through the SMS

If your sponsorship licence is accepted, you can then begin to assign certificates of sponsorship to your prospective employees. They will need to include their unique certificate of sponsorship number in their application.

Some of the duties you will need to fulfil as an employer of an overseas national are:

  • Check your international workers have the necessary skills and qualifications to do their jobs
  • Keep copies of workers’ professional accreditations
  • Only assign certificates of sponsorship to candidates who are suitable for the job
  • Tell UKVI if your sponsored workers are not complying with the conditions of their visa

For more information on how we can help you to acquire your sponsorship licence and keep with the duties as an employer of an overseas national, please call us now on 0330 433 1213.
